Law Enforcement's Rules of Engagement

IN THE WAKE OF A FAILED ATTEMPT BY LAW ENFORCEMENT AGENCIES TO CHARGE HELLS ANGELS MOTORCYCLE CLUB SAN JOSE WITH INVOLVEMENT IN THE DEATH OF A PATRON OF A LOCAL STRIP CLUB, AS WELL AS BEING A CRIMINAL STREET GANG, THE CLUB HAS FILED SUIT IN FEDERAL COURT ALLEGING CIVIL RIGHTS VIOLATIONS AGAINST ITS MEMBERS.

THE DEFENDANTS INCLUDE SHERIFF'S DEPUTY ROBERT LINDERMAN AND SAN JOSE POLICE OFFICER JORGE GILBLANCO. THE CLUB ALLEGES THAT EACH OF THESE INDIVIDUALS SUPPLIED FALSE AND MISLEADING INFORMATION AND OMITTED CRITICAL FACTS IN ORDER TO OBTAIN SEARCH WARRANTS.

THE CLUB FURTHER ALLEGES THAT IN THE EXECUTION OF THESE WARRANTS, FEDERAL, STATE AND LOCAL LAW ENFORCEMENT AGENCIES RAIDED THE HOMES OF MEMBERS, MEMBER'S RELATIVES, MEMBERS GIRLFRIENDS AND PEOPLE THAT JUST HAPPENED TO KNOW MEMBERS OF THE CLUB.

DURING THE RAIDS CHILDREN WERE PULLED NAKED FROM THE SHOWER, HAD AUTOMATIC WEAPONS HELD TO THEIR HEADS AND WERE ISOLATED FROM THEIR HANDCUFFED MOTHERS; HOMES LISTED ON THE HISTORICAL REGISTER WERE SET AFIRE WITH FLASH-BANG DEVICES; THREE PET DOGS WERE SHOT TO DEATH; TRUCKLOADS OF MEMBER'S PROPERTY WERE CONFISCATED; INCLUDING MOTORCYCLES, FURNITURE, CLOTHING, PHOTO ALBUMS, JEWELRY AND A HOST OF OTHER PERSONAL ITEMS. THE LIST GOES ON AND ON.

IT TOOK OVER A YEAR AND MULTIPLE COURT ORDERS TO GET THE MAJORITY OF THE PROPERTY RETURNED TO ITS RIGHTFUL OWNERS. TO THIS DATE, THERE'S IS PROPERTY THAT HAS NOT BEEN RETURNED. INCLUDING THOUSANDS OF DOLLARS IN DEFENSE FUND MONEY WHICH LAW ENFORCEMENT CLAIMS WAS STOLEN FROM THE SHERIFF'S PROPERTY ROOM.

For decades the City of San Jose Police Department and the Santa Clara County Sheriff’s Office have harassed and violated the Constitutional Rights of the Hells Angels Motorcycle Club of San Jose. Members put up with being stopped when riding and searched by law enforcement just because they were Hells Angels, but because of the cost of law suits these violations were not pursued. When the above happened law enforcement went too far, and the members sued.

After years of battling in court, and thousands of dollars in legal costs, the San Jose Hells Angels Motorcycle Club saw justice. The courts ordered the City of San Jose to pay $800,000.00, and the County of Santa Clara $990,000.00 to the San Jose Hells Angels Motorcycle Club.

The members fought for years to win this battle, but they could not have done it without the help of their supporters. Winning this battle didn’t just help the San Jose Hells Angels, but all Motorcycle Clubs and bikers, because it lets law enforcement know that if they indiscriminately violate the Constitutional Rights of Motorcycle Club members and non-club bikers, it will cost them dearly.

Hells Angels Motorcycle Club of San Jose wishes to thank everyone who assisted with donations of money and time to help, as we are all American citizens, and deserve to be treated as such. Without the donations of Motorcycle Clubs, bikers and other motorcycle enthusiast, as well as private citizens, this battle could not have been won. The San Jose Hells Angels admire and respect all of you, and will continue to support you as you have supported us.
